1. Introduction / Who We Are
These Terms of Service govern the provision of services by JMC Legal Services Limited trading as Priority Process (Company No. NI690494), registered in Northern Ireland, with registered offices at Wellington Business Park Centre, 3 Wellington Park, Belfast BT9 6DJ. We are contactable by telephone on 028 9092 3333.
Priority Process is a professional process serving and private investigations firm operating under a licence issued by the Private Security Authority (PSA). Our director, Justin McGibbon, is a member of the Association of British Investigators (ABI), the World Association of Detectives (WAD), and serves as a Welfare Officer with the World Association of Professional Investigators (WAPI).
These Terms constitute the entire agreement between Priority Process and the instructing party (“the Client”) in respect of all services provided. By instructing us, the Client agrees to be bound by these Terms.
2. Scope of Services
Priority Process provides the following services:
- Process Serving — personal service of legal documents including claims, injunctions, statutory demands, and court orders.
- Document Delivery — secure delivery of time-sensitive legal and commercial documentation.
- Tracing — lawful location enquiries for debtors, missing persons, witnesses, and beneficiaries.
- Surveillance — covert and overt observation and evidence-gathering conducted in strict compliance with applicable law.
- Due Diligence — background verification and intelligence reports for individuals and commercial entities.
- Express Service — priority same-day or next-day process serving and delivery for urgent instructions.
All services are delivered in compliance with applicable Northern Ireland and UK law. We do not undertake any instruction that is unlawful, unethical, or contrary to the professional standards of the bodies to which our director belongs.
3. Instructions
Instructions may be submitted by email, telephone, or via any secure method agreed with the Client. To accept an instruction, we require: the full name and last known address of the subject (where applicable); copies of any documents to be served; the required deadline; and sufficient contact information for the instructing party.
Priority Process reserves the right to decline any instruction at its absolute discretion, without being required to give reasons. Acceptance of an instruction is confirmed in writing. Instructions accepted from solicitors or other regulated professionals are taken on the understanding that the instructing party has the authority of their client to engage our services.
4. Fees and Payment
A fee quotation will be provided before work commences. Quotations are valid for 14 days from the date of issue. Disbursements (including mileage, court fees, travel outside the Belfast metropolitan area, and overnight accommodation where required) are charged in addition to professional fees and will be itemised on the invoice.
Payment is due within 14 days of the invoice date unless otherwise agreed in writing. Priority Process reserves the right to suspend or withhold delivery of reports and affidavits pending settlement of outstanding invoices. We reserve the right to charge statutory interest on overdue accounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
5. Confidentiality
All instructions and associated information are treated as strictly confidential. Priority Process will not disclose the identity of the Client, the nature of the instruction, or any information obtained in the course of carrying out an instruction to any third party, except where required by law, court order, or a competent regulatory authority.
Confidentiality obligations survive the termination of these Terms.
6. Data Protection
Priority Process is registered with the Information Commissioner’s Office (ICO Registration No. C1292310). We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
Personal data provided by or obtained on behalf of the Client is used solely for the purpose of fulfilling the instruction. Data is retained only for as long as is necessary to fulfil our legal, regulatory, and business obligations. Data subjects may exercise their rights (access, rectification, erasure, restriction, portability, and objection) by contacting us in writing at the address above. Complaints regarding data processing may be directed to the ICO at www.ico.org.uk.
7. Liability
Priority Process provides factual field services. We are not a firm of solicitors and nothing in our reports, affidavits, or communications constitutes legal advice. Solicitors and other regulated professionals who instruct us remain solely responsible for the advice they provide to their own clients and for the conduct of any proceedings.
Our aggregate liability to the Client for any claim arising out of or in connection with the provision of services shall not exceed the total fees paid by the Client in respect of the specific instruction giving rise to the claim. We accept no liability for loss caused by circumstances beyond our reasonable control, inaccurate or incomplete information supplied by the Client, or the acts or omissions of third parties.
8. Intellectual Property
All reports, affidavits, photographic evidence, and documentation produced by Priority Process remain the intellectual property of JMC Legal Services Limited. A licence to use such materials is granted to the instructing Client for the specific purpose for which the instruction was given. Materials may not be reproduced, shared with third parties, or used for any other purpose without our prior written consent.
9. Complaints
Priority Process is committed to delivering a high standard of service. If the Client is dissatisfied with any aspect of our service, a complaint should be submitted in writing to our registered address or by email to the contact details provided at the time of instruction. We will acknowledge all complaints within 2 working days and aim to resolve them within 14 working days of receipt. Where resolution requires additional time, we will keep the Client informed of progress.
10. Governing Law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the law of Northern Ireland. The parties submit to the exclusive jurisdiction of the courts of Northern Ireland.
11. Changes to These Terms
Priority Process reserves the right to amend these Terms at any time. Where changes are material, we will provide not less than 14 days’ notice to existing clients with active instructions. Continued use of our services following notification of amended Terms constitutes acceptance of those Terms. The current version of these Terms is always available on our website and upon request.
